I live in a one party state...Ohio. My mother has demensia and several of my brothers have made her give POA's to them. They made her make several phone calls to me where she was forced to make nasty voicemail messages to me. My mother did not end the call after each voicemail and you can hear my brothers using threats, undue influence, and harsh language against her. I started a guardianship proceeding in Ohio and they abruptly took her to a two party state-Florida. Can my voicemail messages legally be used in Florida at a hearing coming up?

The truth is that it is entirely up to the police whether you will be ARRESTED for recording other people, entirely up to a district attorney whether you will be CHARGED with recording other people, and entirely up to a judge or jury whether you will be CONVICTED for recording other people. Here's the bottom line. Law enforcement can do any damn thing they want, regardless of the law, because the interpretation of the majority of laws is subjective.

I have gut feelings my wife is cheating on me with someone at her job. I have looked at and considered downloading software that I can use to listen in on her cell phone conversations. I have not done this because when I go to the add to cart and payment options, it asks for so much personal information about me, I feel as though my download and use of the product will be tracked due to new laws under the Bush wiretap program, therefore, someone else will know that I am listening in on her phone conversations and before I know it the feds will be at my door to confiscate my computer. Is this likely?
