I have one question.
What would happen to School if School told other adult about my personal life?
Is that against Law?

Last week I was pulled out of class by security because they said someone had seen me committing graffiti. They search me and I had a marker that I frequently use in one of my classes and they also found a small drill bit that I placed in my pocket during my auto class. The police were called and I was cited with graffiti tools and suspended. I am a good student, play sports and have never been in trouble. I feel that this is so unfair and now because someone said something that was not true I am now going to be labeled for the rest of my life.

Yesterday I, along with 4 other students, were accused of smoking on school grounds. The vice-principal claimed to have seen smoke exiting one student's mouth. We were all individually questioned and searched by the student resource officer and no cigarettes of any sort were found. No evidence to provide that we were in fact smoking. We all received in school suspensions and are not allowed to attend our regular class schedule. I feel as though not only was my 4th right violated by an unreasonable search, but I also feel that the education I am entitled to is being withheld on account of an unlikely suspicion.

I am wondering is someone knows the answer to this. Today i was in school, and i left with out permission. I am 18, and this is a private school. I left to get my work done outside, and away from distractions. I returned to turn my work in and leave. But the school officials wanted to search me. I refused, and then i was told that i would have an in house suspension if i refuse the search. I didnt want any further trouble so i let them search me, and they found my ciggarettes. I only got an in school suspension. Did they have the right to threaten a suspension if i dint comply with their search?

Today, January 22, 2008 in Oxford, Massachusetts the local high school was locked down because someone found a bullet in the boys bathroom. Every student was search, every locker and all the cars. Isn't this an over-reaction which I assume is to prevent another Columbine-type assault? According to your article, this would have required a warrant, right? I certainly want our schools to be safe, but that shouldn't be at the cost of our young citizens rights.

I have two follow-up questions:
Does the situation change at all for an adult student (over 18)in a public school. Many of my senior students are over 18.
If a student is told that her backpack will be searched, can she comply under protest in the presence of witnesses to preserve her 4th amendment rights?
